1. Introduction
These Terms & Conditions govern the use of Docpitara.com ("Platform"), a document management and sharing service provided in integration with the SCIGST software.
By accessing or using the Platform, the user (Consultant/Chartered Accountant/SCIGST Customers and their clients) agrees to comply with these Terms.
2. Nature of Service
Docpitara.com is a facilitation platform that enables:
- Tax Consultants, Chartered Accountants ("Consultants") or any SCIGST Customers opted for Docpitara to upload and share documents with their respective clients.
- Clients ("End Users") to securely access and download documents shared by their Consultants (SCIGST Customers).
The Platform acts purely as a document transfer and access interface.
3. User Roles
3.1 Consultant / Chartered Accountant / SCIGST Customer
- Primary user of the Platform.
- Responsible for uploading, managing, and sharing documents.
3.2 End User (Client)
- Receives login access to download/view documents shared by the Consultant.
4. Storage and Data Handling
- All documents uploaded on Docpitara.com are stored in the Google Drive account of the respective Consultant/CA/SCIGST Customer.
- The Platform does not provide independent storage infrastructure.
- Any storage limits, charges, or upgrades related to Google Drive shall be:
- Fully borne by the Consultant/CA.
- Managed directly by the Consultant/CA with Google.
5. Integration with SCIGST
- Docpitara.com is integrated with SCIGST software and its usage is dependent on an active SCIGST license.
- Upon:
- Expiry, or
- Deactivation of SCIGST → Access to Docpitara.com will also be automatically discontinued.
6. Responsibility & Liability Disclaimer
6.1 Content Responsibility
- All documents uploaded, shared, or transmitted via the Platform are solely the responsibility of the Consultant/CA/SCIGST Customer.
- SCIGST and Docpitara.com:
- Do not verify, validate, or audit any documents.
- Are not responsible for accuracy, completeness, legality, or authenticity of documents.
6.2 End User Interaction
- SCIGST has no contractual relationship or obligation towards End Users (clients of Consultants/CA).
- No service, support, or assistance is guaranteed to End Users.
6.3 Technical or User-side Issues
- SCIGST shall not be liable for:
- Internet issues
- Device compatibility issues
- Login/access problems at user end
- Google Drive related errors or downtime
6.4 Data Loss or Security
- Since storage is maintained via Google Drive:
- SCIGST is not responsible for data loss, corruption, or unauthorized access.
- Consultants are responsible for managing their own data security and permissions.
7. No Warranty
The Platform is provided on an "as-is" and "as-available" basis without any warranties, including:
- Continuous availability
- Error-free performance
- Data integrity assurance
8. Limitation of Liability
Under no circumstances shall SCIGST or Docpitara.com be liable for:
- Direct or indirect damages
- Loss of data, business, or reputation
- Any disputes between Consultant and their clients
9. Termination
- Access to Docpitara.com is automatically terminated upon:
- Deactivation of SCIGST license
- SCIGST reserves the right to suspend or terminate access in case of misuse.
10. Acceptance of Terms
By using Docpitara.com:
- Consultants/CA's/SCIGST Customers and End Users acknowledge that they have read, understood, and agreed to these Terms & Conditions.
11. Governing Jurisdiction
These Terms shall be governed by the laws of India, and any disputes shall be subject to jurisdiction of courts in Ahmedabad, Gujarat as applicable.
Privacy Policy & Data Processing Terms -- Docpitara.com
1. Introduction
This Privacy Policy and Data Processing Terms ("Policy") govern the collection, usage, storage, and handling of data on Docpitara.com ("Platform"), operated in integration with SCIGST.
By using the Platform, Consultants, Chartered Accountants ("Consultants"), and SCIGST Customers and their clients ("End Users") agree to this Policy.
2. Nature of Data Processing
- Docpitara.com acts solely as a technology facilitator for document transfer.
- The Platform does not own, control, or independently store user data.
Role Classification
- Consultant/CA → Data Controller
- Docpitara.com / SCIGST → Limited Technology Facilitator (Intermediary)
- End User (Client) → Data Subject
3. Data Collected
The Platform may collect limited operational data such as:
- Login credentials (username, password -- encrypted)
- Email addresses
- Access logs (IP address, timestamps)
- File metadata (file name, size, upload/download activity)
⚠️ The Platform does not claim ownership of document content.
4. Data Storage & Infrastructure
- All documents are stored in the Consultant's/CA's/SCIGST Customers Google Drive account.
- SCIGST / Docpitara.com:
- Does not store documents on its own servers
- Does not maintain backup copies
- Has no control over Google Drive policies or security
- Any:
- Storage limits
- Data retention
- Security configurations are solely managed by the Consultant/CA/SCIGST Customer
5. Purpose of Data Usage
Data is processed strictly for:
- Authentication and login access
- Enabling document upload/download
- Maintaining audit trails (basic logs)
- Platform performance and security monitoring
No data is used for:
- Selling to third parties
- Advertising
- Profiling End Users
6. Data Sharing & Disclosure
Docpitara.com / SCIGST:
- Does not share data with third parties, except:
- When required by law or government authority
- For compliance with legal obligations
All document sharing is initiated and controlled by the Consultant/CA/SCIGST Customers.
7. Data Security
- Industry-standard security practices are implemented for:
- Authentication
- Encryption (where applicable)
- Secure access control
However:
- SCIGST does not guarantee absolute security.
- Security of documents depends on:
- Google Drive configuration
- Consultant's access control practices
8. Data Retention
- Data remains accessible only while:
- Upon deactivation:
- Platform access is discontinued
- No obligation exists for continued data access via Docpitara
Consultants are solely responsible for:
- Backup
- Retention policies
- Data archival
9. End User Privacy
- End Users access documents only as permitted by the Consultant/CA/SCIGST Customer.
- SCIGST has:
- No direct relationship with End Users
- No obligation to provide support or data access
10. Disclaimer on Sensitive & Financial Data
- Consultants may upload sensitive financial, tax, or personal documents.
- SCIGST / Docpitara.com:
- Does not review, validate, or monitor such data
- Is not responsible for misuse, leakage, or unauthorized sharing
11. Limitation of Data Liability
Under no circumstances shall SCIGST or Docpitara.com be liable for:
- Data breaches arising from:
- Weak passwords
- Unauthorized access by Consultant or End User
- Google Drive vulnerabilities
- Loss, corruption, or deletion of files
- Misdelivery of documents to incorrect recipients
12. Compliance Responsibility
- Consultants/CA agree that they:
- Are solely responsible for complying with:
- Applicable data protection laws
- Client confidentiality obligations
- Professional ethics standards
SCIGST acts only as a technology provider, not as a compliance authority.
13. Third-Party Services
The Platform depends on third-party services including Google Drive.
- SCIGST:
- Has no control over third-party policies
- Is not liable for:
- Downtime
- Data loss
- Policy changes
Users are advised to review Google's privacy and security policies separately.
14. Indemnity Clause
The Consultant agrees to indemnify and hold harmless SCIGST and Docpitara.com from:
- Any claims, damages, or disputes arising from:
- Incorrect, illegal, or misleading documents
- Breach of client confidentiality
- Data misuse or unauthorized sharing
15. Policy Updates
SCIGST reserves the right to modify this Policy at any time. Continued use of the Platform constitutes acceptance of updated terms.
16. Jurisdiction
This Policy shall be governed by the laws of India. Any disputes shall be subject to the jurisdiction of Ahmedabad, Gujarat.
17. Absolute Disclaimer (Optional Strong Legal Add-on)
Docpitara.com and SCIGST shall be treated strictly as a pass-through system and shall not be construed as:
- Data processor in legal liability terms
- Custodian of records
- Trusted repository
All legal responsibility for documents remains entirely with the Consultant.
Docpitara.com -- Professional Use, Compliance & Data Governance Terms
1. Professional Compliance (ICAI-Aligned Use)
The Platform is intended for use by Chartered Accountants and Tax Consultants ("Professionals") or SCIGST Customers in the course of their professional practice.
The Professional expressly acknowledges and agrees that:
- They are solely responsible for compliance with:
- The Code of Ethics issued by the Institute of Chartered Accountants of India (ICAI)
- Applicable provisions of the Chartered Accountants Act, 1949
- Client confidentiality obligations and fiduciary duties
- Use of Docpitara.com shall not:
- Compromise professional independence
- Violate confidentiality norms
- Result in unauthorized disclosure of client information
- The Platform is merely a technology enabler and shall not be interpreted as:
- A professional advisory system
- A compliance tool
- A regulated records repository
2. Absolute Client Confidentiality Responsibility
- All documents uploaded, shared, or transmitted via the Platform are under the exclusive control and responsibility of the Professional.
- The Professional shall ensure:
- Proper client consent (where required)
- Correct recipient mapping before sharing
- Appropriate access controls
- SCIGST / Docpitara.com shall have:
- No visibility obligation
- No monitoring responsibility
- No confidentiality liability
3. Data Control & Ownership
- The Professional is the sole Data Controller of all documents and personal/financial data.
- Docpitara.com operates strictly as a non-custodial, pass-through interface.
At no point shall:
- Ownership of data transfer to SCIGST
- Custodianship be inferred or implied
4. Enterprise-Grade Liability Disclaimer (Strict Version)
4.1 No Verification / No Audit
- SCIGST / Docpitara.com:
- Does not verify, validate, audit, or review any document
- Does not guarantee correctness, legality, or completeness
4.2 No Professional Liability
Under no circumstances shall the Platform be liable for:
- Incorrect filings
- Financial losses
- Tax disputes
- Client litigation
Arising from documents shared through the Platform.
5. Data Processing & Security Allocation
5.1 Infrastructure Dependency
- All document storage is routed via Google Drive of the Professional.
- Security, encryption, and access depend entirely on:
- Google infrastructure
- Professional's configuration
5.2 Explicit Risk Transfer
The Professional agrees that:
- Any data breach, leakage, or unauthorized access shall be deemed to arise from:
- Their credentials
- Their storage configuration
- Their sharing practices
SCIGST shall bear zero liability in such cases.
6. End User (Client) Disclaimer
- Clients are granted access only as a convenience feature.
- SCIGST:
- Has no contractual obligation towards End Users
- Provides no support, warranty, or assurance to them
All disputes between:
- Professional and Client → Shall be resolved independently without involving SCIGST.
7. Indemnity (Strong Form Clause)
The Professional agrees to fully indemnify, defend, and hold harmless SCIGST, Docpitara.com, its directors, employees, and affiliates against:
- Any claims, damages, penalties, or legal proceedings arising from:
- Breach of confidentiality
- Incorrect or misleading documents
- Unauthorized sharing
- Non-compliance with ICAI or legal requirements
- Client disputes or financial claims
This indemnity shall survive termination of services.
8. No Data Custodianship Declaration
It is explicitly clarified that:
Docpitara.com shall not be treated as:
- A document repository
- A record-keeping system under law
- A statutory archive
Professionals must maintain independent records as required under applicable laws and ICAI guidelines.
9. Service Dependency & Termination Risk
- Docpitara.com is inseparably linked to SCIGST license.
- Upon deactivation:
- Access is revoked immediately
- No data retrieval guarantee is provided
The Professional is solely responsible for:
- Data backup
- Business continuity planning
10. Limitation of Liability (Maximum Protection Clause)
To the fullest extent permitted by law:
- Total liability of SCIGST (if any) shall be limited to ₹0 (Zero Liability).
- SCIGST shall not be liable for:
- Direct damages
- Indirect damages
- Consequential losses
- Loss of business, goodwill, or data
11. Force Majeure
SCIGST shall not be liable for failure or delay caused by:
- Cloud service outages (including Google)
- Cyber incidents
- Government restrictions
- Natural disasters
- Any policy changes for Google Drive
12. Explicit Acceptance
By using the Platform, the Professional confirms that:
- They understand the non-custodial nature of the system
- They accept full professional and legal responsibility
